TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Promotion commences at 12am on 11 September 2025 and ends at 11:59pm on 25 September 2025 (“Promotional Period”).
3. Entry is only open to residents of Australia aged 18 years or over (“Eligible Entrants”).
4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. Eligible Entrants must complete the following criteria.
• Complete a transaction on smithswinestore.com.au that includes a purchase of at least one Running with Bulls wine (in any size)
6. The cost of accessing the relevant platforms will depend on the entrant’s individual Internet Service Provider.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Incomplete or indecipherable entries will be deemed invalid.
9. One entry per transaction that includes a Running with Bull wine purchase.
10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11. The prize draw will take place at the Hill-Smith Family Estates, 40 Eden Valley Rd, Angaston, 5353, South Australia on at 2pm on 30 September 2025. The winner will be chosen at random and contacted by email within two days of the draw to advise how the prize will be provided.
12. The 3 valid entries drawn will win one of three Smith’s Wine Store gift vouchers valued at $100 each.
13. Total prize pool value is $300.
14. The Promoter’s decision is final and no correspondence will be entered into.
15. Online purchases:
a. Please note that the availability of stock may not be updated, and the fact that you have checked out and made payment on your order does not necessarily mean that your order is confirmed. This could arise due to a lag time between the update of inventory on our system and the high volume of purchases.
b. In the event of conflicting purchases leading to stock insufficiency, Smith’s Wine Store has the right to cancel any purchase. Smith’s Wine Store will, of course, inform you immediately and reimburse any payments made via the method of payment used for the purchase.
c. Smith’s Wine Store is not responsible for any failure to complete your transaction, or any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination of these, or any other technical failures including any damage to any person's mobile handset or computer related to, or resulting from, this promotion.
d. Smith’s Wine Store does not accept any responsibility for late, lost, incomplete, delayed, corrupted or misdirected transactions, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
e. Any fraudulent behaviour may result in cancellation of any order and/or inability to access the Online Channels or any other Smith’s Wine Store website. Smith’s Wine Store has the right, in its sole discretion, to disqualify or prohibit from participating in the promotion any individual who Smith’s Wine Store believes has engaged, has attempted to or intends to attempt to engage, in conduct that annoys, abuses, threatens, or harasses any other participant or any representative of Smith’s Wine Store. The use of agents or automated devices, programs, or methods to participate is prohibited, and adidas has the right, in its sole discretion, to disqualify any participant that it believes may have participated using such an agent or automated device, program, or method.
20. Each customer must comply with these Terms and Conditions. By participating in the promotion, each customer agrees to indemnify and to keep indemnified Smith’s Wine Store (including its officers, employees and agents) in relation to all loss and damage whatsoever which is suffered (including but not limited to indirect or consequential loss) by Smith’s Wine Store as a direct or indirect result of the customer acting inconsistently with or breaching any part of these Terms and Conditions.
21. Smith’s Wine Store’s decision on all aspects relating to the promotion is final and no correspondence will be entered into.
22. Smith’s Wine Store reserves the right to amend these terms and conditions.
23. Smith’s Wine Store reserves the right to change, limit or cancel this promotion at any time.
GENERAL
24. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including but not limited to by vandalism, unauthorised intervention or fraud, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right, subject to any written directions of the lottery authorities, to cancel, terminate, modify or suspend or recommence the Promotion.
a. to disqualify any entrant; or
b. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize, then the prize will be forfeited and a redraw will occur.
26. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
27. The prize is not transferable or exchangeable and cannot be taken as cash.
28. A draw for any unclaimed prize may take place at 2pm on 10 October 2025 at Hill-Smith Family Estates, Angaston, 5353, South Australia, subject to any directions from a regulatory authority. Winners, if any, will be notified by email.
29. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
a. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b. any theft, unauthorised access or third party interference;
c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d. any variation in prize value to that stated in these Terms and Conditions;
e. if the party event is postponed or cancelled for any reason beyond the reasonable control of the Promoter;
f. any tax liability incurred by a winner or entrant; or
g. attendance at the prize event.
